Terms of Service | Aleph Digital

These terms govern your use of Aleph Digital (“we”, “us”), a service that builds and hosts websites for Australian small businesses. By subscribing you agree to them.

The service

You provide information about your business through our form. We generate a website from it and host it for you. While your subscription is active we provide hosting, an SSL certificate, unlimited content updates through your account, and email support.

We may improve or change how the service works over time. We will not materially reduce what your plan includes without telling you first.

Plans and billing

Subscriptions are month-to-month with no lock-in contract. Current plans are $29/month (Starter) and $39/month (Professional), in Australian dollars.
Payment is processed by Stripe. You authorise us to charge your payment method each billing period until you cancel.
If a payment fails we will attempt to contact you. Sites with unpaid subscriptions may be taken offline.
We may change prices with at least 30 days’ notice by email. Price changes never apply to a period you have already paid for.

Cancellation

You can cancel at any time from your account page — no phone call required. When you cancel:

Your website stays live until the end of the billing period you have already paid for.
You keep full access to edit your site until that date.
After that date the website is taken offline.
We email you a confirmation when the cancellation is recorded.

30-day money-back guarantee

If you are not happy within 30 days of your first payment, email support@alephdigital.com.au and we will refund your subscription payments. Domain registration fees are excluded, because domain registrations are non-refundable once lodged with the registry.

This guarantee is in addition to your rights under the Australian Consumer Law, which cannot be excluded. Our services come with guarantees that cannot be excluded under that law, including a right to a remedy for a major failure.

Domains

Every site can use a free yourname.alephdigital.com.au subdomain. That subdomain belongs to us and is provided only while your subscription is active.
You may connect a domain you already own, or buy one through us. A domain you register or bring is yours, and you keep it if you leave.
Domain fees are separate from your subscription, charged at the registry’s rate, and are non-refundable once registered.
.au domains require a valid ABN or other Australian presence, which the registry verifies. We cannot register one without it.

Your content

You keep ownership of everything you supply — text, images, logos and business information. You grant us the licence needed to host, reproduce and publish it as part of building and serving your website.

You are responsible for having the right to use what you upload. Do not upload content you do not own or have permission to use, and make sure any claims you make about your business are accurate and comply with the Australian Consumer Law.

Our materials

The templates, generator and platform remain ours. Your subscription grants you the right to use the website we produce for your business, not to resell the underlying templates or platform.

Acceptable use

You may not use the service to publish or distribute:

Unlawful, misleading or deceptive content.
Content that infringes someone else’s intellectual property.
Malware, phishing pages or content designed to defraud.
Content that harasses or vilifies a person or group.
Adult content, or anything promoting illegal goods and services.

We may suspend or terminate a site that breaches these rules. Where practical we will contact you first. For serious or unlawful breaches we may act immediately.

Availability

We aim to keep sites online continuously but do not guarantee uninterrupted service. Maintenance, provider outages and events outside our control can cause downtime. We are not liable for losses arising from downtime beyond our reasonable control.

Liability

Nothing in these terms excludes any right or guarantee you have under the Australian Consumer Law. To the extent the law allows, our liability for any claim relating to the service is limited to resupplying the service or refunding the amount you paid us in the 12 months before the claim, whichever we choose. We are not liable for indirect or consequential loss, including lost profits or lost business.

Changes to these terms

We may update these terms. The current version always appears on this page with its last updated date. We will email you before material changes take effect. Continuing to use the service after that means you accept the updated terms.

Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that jurisdiction.
